Article 3 – Applicability
These General Terms and Conditions apply to any offer made by the entrepreneur and to any concluded distance contract or orders between the entrepreneur and the consumer.
Before concluding the distance contract, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the Terms and Conditions are available for inspection at the entrepreneur's office and will be sent to the consumer free of charge upon request.
If the distance contract is concluded electronically, the entrepreneur will, before the contract is concluded, make the text of these General Terms and Conditions available electronically in such a way that the consumer can easily store it on a durable medium.
If, in addition to these General Terms and Conditions, specific product or service conditions apply, the consumer can rely on the most favourable condition in case of conflict between the two.
Article 4 – The Offer
The offer must clearly specify if it is limited in time or subject to conditions.
The offer is non-binding, and the entrepreneur is entitled to change and adjust the offer.
The offer will contain a full and accurate description of the products and/or services offered, sufficient to allow the consumer to make an informed judgment about the offer. If the entrepreneur uses images, these will represent the products and/or services faithfully, but discrepancies may exist.
Article 5 – The Agreement
An agreement is concluded when the consumer accepts the offer and meets the conditions attached to it.
If the consumer accepts the offer electronically, the entrepreneur will promptly confirm the receipt of this acceptance. If this confirmation is not received, the consumer may cancel the agreement.
The entrepreneur will take appropriate measures to ensure the security of electronic data transfers and a secure online environment.
Article 6 – Right of Withdrawal
The consumer has the right to cancel the contract without providing a reason within 30 days of receiving the product.
During this period, the consumer must handle the product with care and return it in the original state and packaging.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the costs for returning the product will be borne by the consumer, including the return shipping to the origin country (China, in this case).
The entrepreneur will refund any payment made by the consumer as soon as possible, but no later than 30 days after the return of the product or after proof of return is provided.
Article 8 – Exclusions of the Right of Withdrawal
The right of withdrawal does not apply to:
-
Custom-made products
-
Personalised products
-
Products that cannot be returned due to their nature
-
Perishable products
-
Audio/video recordings or software where the seal is broken
Article 9 – The Price
The price of products and services remains fixed for the duration of the offer, unless changes in VAT rates apply.
For products subject to market fluctuations, the prices may vary, but this will be clearly stated in the offer.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products meet the requirements of the agreement, the product description, and reasonable standards of quality.
Defective or incorrectly delivered products must be reported within 30 days after delivery.
Article 11 – Delivery and Execution
The entrepreneur will handle orders with care and strive for delivery within 30 days unless otherwise agreed.
If a product cannot be delivered, the entrepreneur will inform the consumer and offer a substitute product. If the consumer does not accept, the contract will be cancelled.
Article 12 – Continuous Contracts: Duration, Cancellation, and Renewal
Consumers may cancel agreements for the continuous delivery of products or services with a notice period of up to one month.
